The inactivity of this forum. | Thu Apr 02, 2015 11:06 pm by Burkman | It's depressing to see how inactive it has been recently. I mean, everybody is pretty much primarily posting in the never ending thread now and there's not enough people here to make this place really booming. We need to find some way to bring more people here before this place just fades into nothingness...
I know for a fact that a lot of boards out there are thriving because of how many people are there. We just need to get back into the game and pull people here. However, where we obtain these people might matter, because we don't to end up pulling in douches like those at Selkath.
I understand that people are busy these days, but it doesn't seem like they're rarely at their computer anymore. I know most of you are still dicking around with your computer. I don't know how we …

| So Bethesda feels obligated to really push this out of proportion...
To those who haven't been following...
Mojang made Minecraft, Mojang's CEO is 'Notch'.
Bethesda has trademarked 'The Elder Scrolls' franchise. (remember this; it's important)
Bethesda announced Skyrim.
Notch came with the idea to name his next game 'Scrolls' as it will have something to do with magic scrolls, but NOTHING whatsoever with 'The Elder Scrolls'.
Bethesda figured ''Hey, we've copyrighted the word 'Scrolls' as part of our TES franchise! We therefore own this word! We must stop anybody using it for their own purposes! To the Lawsuit Mobile!''
So now they're suing Mojang for copyright infringement on a word they've somehow assumed they own... And even though Notch has, on several occasions told and proved to Bethesda's lawyers that the two games will have absolutely nothing in common... They're still pushing it...
I personally think Bethesda is being a dick about having to share a word with a smaller game company... And maybe it's some sort of half-baked ditch to take Mojang out or something... It's just stupid really... It's like whoever made Star Trek suing Lucas for putting 'Star' in his movies... Or a lawsuit between Valve, Visceral Studios (or EA) and Deep Silver and the word 'Dead'...
Anyways... /discuss...

| Old news is Old.
But it is silly, I think it's even silly to own the rights too a word.

But it is silly, I think it's even silly to own the rights too a word. Copyrighting isn't to own the 'rights to a word', but to a product and it's name... But it's name so long as it's connected to that product and it's the entire phrase, not just a single word... Clearly Bethesda's lawyers have missed that class in their college years... And I posted this due to the new turn around- Notch proposed to not have the word Scrolls copyrighted and a warning coming with the game that it's not connected to TES... This was to answer their main claim of the two games sounding too close together, which might cause confusing in some customers... Bethesda's Lawyers thew this out the window and continued their blissful pursuit for 'justice'...

| Obviously this is Bethesda's accounting department going all up in their high horses about this. I remember just the other month ago Notch and Todd Howard (bethesda) were interviewing each other in a E3 video. It's sad to see communications break down, but I think Bethesda is in the wrong. | |

| To anyone interested, Mojang 'won' the first hearing. Bethesda were denied an interim injunction (about which first hearings on trademarks are about). An interim injunction is where the (supposedly) copyrighted name is made to no longer be used by either parties until the case is completely settled. That's not really a massive win for Notch, though, as it doesn't really say anything about where this would go. It was probably simply ruled as not to interfere with Bethesda's Skyrim planes (which has Scrolls in it). If the injunction had been granted, Bethesda might not have been able to launch Skyrim this November (as court cases on copyrights do tend to drag on...). To anyone following the case, and a Law-freak like yours truly, here's a bit more you can read on the actual conflict and the TM stamp in the game-industry in general. A relatively well-writ article on Bethesda v. Mojang'Trademarks and Games', another decent article. Also, I would be remiss to leave out the Escapist article... | |
